Any moneys received pursuant to this subsection shall be transmitted to the state treasurer, who shall credit the same to the comprehensive public health plan cash fund, which is hereby created and referred to in this subsection as the “fund”. Any interest derived from the deposit and investment of moneys in the fund shall be credited to the fund. Any unexpended and unencumbered moneys remaining in the fund at the end of any fiscal year shall remain in the fund and shall not be credited or transferred to the general fund or another fund. Moneys in the fund may be expended by the state department, subject to annual appropriation by the general assembly, for the development of the plan described in this section.

For a student with asthma, this would also include an emergency care plan.5 An IHCP addresses what the school will do to establish and maintain a safe school environment for the student with asthma. Emergency care plan – This is a medical plan from your child’s doctor for the school to follow to treat asthma while the student is at school. 504 plans are formal plans that schools develop to give kids with disabilities the support they need. That covers any condition that limits daily activities in a major way. Unlike an IEP, a 504 will not include academic goals, benchmarks, or measurements—or the funds to back-up these supports.

Having a legal document is also important because should any pushback arise, having a nut allergy 504 Plan in place gives you the power to enforce due process. If for some reason the school views your child’s accommodations as suggestions instead of legal obligations, you have a piece of paper that says otherwise to back you up. Hopefully your school will not fight you, your family, or your nut allergy 504 Plan. But if it does, you will be able to refer back to the agreement. And it’s nice to know you have that protection in place. The plan, including core public health services and standards, shall prospectively cover up to five years, subject to annual revisions and the implementation schedule established by the state board.

Creating a nut allergy 504 Plan won’t be the end conversation, it’s actually just the beginning. But it gives everyone a common ground to start and understand how to move forward. It must be renewed every year, so there will always be room to make improvements and modifications. If your child has a temporary IEP, a long lasting 504 Plan in addition to the IEP might be the best way to organize your accommodations, but it’s up to you.
